UP Control of Gunda Act 1970
Definitions
- District Magistrate, Additional District Magistrate Gunda authorized by the State Government means:-
- IPC. Crimes of 153, 152 and 294 Chapter 15,16,17,22.
- (Religion-related, body-related, property-related insult, resentment) To commit a crime, to get it done; Habit of conspiracy: Criminal
- Convicted under Immoral Traffic Act
- Sentenced thrice in Public Gambling Act, Excise Act
- addicted to making obscene comments on women
- General reputation is a threat to society and
- Broker (Tout) Bribing a public servant, taking unauthorized possession
Extension after amendment dated 04.02.2015:-
- Be affected by Cooperative Regulation Act 1976 and Prevention of Cow Slaughter Act, Cruelty to Animals Act, human trafficking, forced labour, sexual exploitation, beggary and commercial exploitation.
- Engaged in a crime punishable under the Unlawful Activities (Prevention) Act and Forest Act.
Section 2
Ostracism of punk
- District Magistrate by giving written notice
- Adequate opportunity to be heard; 6 months' exclusion on the basis of evidence
Specific -
- Factual details must be given in the notice.
- Permission for temporary return during the period of exclusion
- Exclusion for up to two years in public interest by providing opportunities available in special circumstances
Section 3,4,5
Appeal -
Appeal to the Commissioner within 15 days against the order passed by the District Magistrate.
The Evidence Act is not fully implemented.
Will be able to take evidence as per appropriate decision.
Section 6 and 8
Punitive action
Crime cognizable and triable by magistrate
forced exclusion upon re-entry
The order of the District Magistrate/Commissioner will not be issued in the court in question.

Section – 10 to 14
- In the proceedings of hooligan control, notice will be issued as per (Chapter 6 of the Criminal Procedure Code).
- Under Section 3(3) of the Act, orders can be given to the person concerned at the time of passing the final decision.
- Inform about your coming and going to the police station in charge of the police station where the case is related and where the exclusion period is.
- No permission to possess sticks, sharp weapons, liquor, ganja, cannabis.
- Permission to go to educational institutions, fairs, markets, markets, cinemas, public places up to a certain distance
- Information to the District Magistrate in case of going out of Uttar Pradesh.
- The above list/conditions are subject to change as per circumstances.
Rule - 6
- The station in-charge reports on this day every fifteen days.
Rule - 7
- Parents, wife in the family of the disfellowshipped person? children? Death of brother or sister, marriage, serious illness, permission to come temporarily and permission subject to conditions -
Special - Format of notice and details of issuing bond etc.

Order regarding effective use of hooligan control and prevention of misuse

- Action should be taken only against those criminals whose activities are within the scope described in the Act.
- The police station head will make a proposal regarding the details of the religious details activities.
- Police officers maid or area officer
- Court proceedings are prevalent, supplemental reports rather than re-doing.
- Hile proposing action against more than 60 men and women under the age of 18 years, the Superintendent of Police should conduct a thorough investigation and forward it to the District Magistrate. Generally no action should be taken under this Act.
